Updated MYFutureJobs Portal Regulations for Expatriate Hiring from June 2023
Malaysia’s Social Security Organisation (SOCSO) updated its regulations for advertising job vacancies on the MYFutureJobs portal (MFJ) before offering positions to expatriates. Effective 15 June 2023, these changes shorten the advertisement period to 14 days and remove the conditional exemption for specialised skills positions. It’s mandatory to advertise on MFJ before applying for the Employment Pass (EP) for expatriates, with some positions having automatic exemptions from advertising. The advertisement duration is now shorter, and there’s no longer a conditional exemption for roles requiring specialised skills. Initiated in January 2021, advertising jobs on MFJ aimed to boost local talent employability. Given the local talent pool sometimes lacks specific skill sets, companies often opt for expatriates to bridge these skill gaps. Thus, talent acquisition and HR teams should note these updates for their expatriate hiring strategies.
Approval from Department of Labour for Expatriate Hiring
Effective 1 February 2023, the Malaysia Digital Economy Corporation (MDEC) mandates companies to provide either an approval letter or proof of application from the Department of Labour Peninsular Malaysia (JTKSM) when applying for a Foreign Knowledge Worker (FKW) Projection. This stipulation aligns with the 21 December 2022 announcement by the Ministry of Human Resource, requiring companies to register with JTKSM for hiring expatriates or FKWs. While MDEC enforces this for FKW Projection applications, the ESD has yet to announce its stance, even with JTKSM’s infographic that mentions ‘ESD12’.
