There are three schemes that the Danish government has put in place for companies to employ highly qualified professionals to obtain residence and a work permit in Denmark.

Companies intending to employ foreign employees can apply for residence and work permits in Denmark using either of the following schemes:

Positive List Scheme

This scheme is for applicants whose profession is presently experiencing a shortage of qualified resident workers.

Estimated time to obtain permit: 1 to 2 months until entry to Denmark and a month before the process is completed.

Duration of Work Permit: A residence and work permit based on the Positive List allows you to stay in Denmark for the period of time your permit is valid. In addition, a permit allows you to stay in the Schengen area for up to 90 days within the latest 180 days.

Recent Immigration Law Changes in Denmark

Overview

Denmark’s government made amendments to the immigration law as of 23 March 2023. The two immigration schemes were extended– the Supplementary Pay Limit scheme and the Supplementary Pay Limit under the Fast Track scheme – now requiring a minimum annual salary of DKK 375,000.

The previous requirement of 20 full-time employees on a permanent basis for Fast Track certification has been reduced to 10 employees.

Also, the government plans to expand the Positive List for People with Higher Education and the Start-Up Denmark scheme.

These schemes automatically grant a three-year period to work or seek jobs to third-country nationals who have completed a Danish professional bachelor, Master or PhD program in Denmark.
